SWAT: A divisional bench of the Peshawar High Court Mingora bench on Tuesday accepted a writ petition of the lawyers against judicial powers delegated executive magistrates and issued notices to the federal and provincial governments.
The divisional bench of PHC Mingora bench comprising Justice Muhammad Naeem Anwar and Justice Muhammad Ijaz Khan approved the petition filed by the Peshawar High Court Mingora Bench Bar Association against the judicial powers of Executive Magistrates in Malakand Division (former PATA).
Barrister Adnan Khan appeared before the court on behalf of the Bar Association and appealed to revoke the judicial powers of the executive magistrates.
The Divisional Bench approved the writ petition for regular hearing and issued notices to the Federal and Provincial Governments.
Mujahid Farooq, President the Peshawar High Court Mingora Bench Bar Association, told this scribe that executive magistrates in Malakand Division have been exercising their judicial powers unconstitutionally and illegally due to which people are facing immense difficulties.
“A double burden has been placed on the magistrates, on the one hand, administrative officers have been assigned the responsibility of magistrates while on the other hand, they have been given judicial powers which have impacted their performance negatively,” Mujahid Farooq claimed.
