Punjab’s proposed defamation law won’t curtail freedom of speech, assures Azma Bukhari

LAHORE: The Punjab government has moved to allay concerns regarding its proposed defamation law, asserting that it will not impede freedom of speech.

Speaking at a press conference in Lahore, on Wednesday, Punjab’s Minister for Information, Azma Bokhari, emphasized that professional journalists need not worry about the legislation.

Bokhari clarified that the law targets those who spread false information without substantiating their claims, rather than genuine journalists. The assurance follows the introduction of the anti-defamation legislation in the Punjab Assembly, which has sparked objections from various quarters, including journalists.

Critics like President of Lahore Press Club, Arshad Ansari, view the law as an attempt to silence dissent and undermine democracy. He announced plans for journalist organizations to counter this legislation and urged the government to uphold democratic values.

Explaining the specifics of the proposed law, Bokhari stated that individuals accused of defamation will be served notices and given an opportunity to defend themselves within a specified timeframe. Cases will be concluded swiftly, within 180 days, and the law will extend to social media platforms as well.

Those found guilty of defamation will be liable to pay damages, with the option to challenge the amount. Bokhari underscored that the accused will have the opportunity to present their defense.

Furthermore, a designated tribunal will handle defamation cases, with judges hearing a limited number of cases daily. Notably, the legislation categorizes defamation cases as civil matters, excluding police intervention or arrest.

In response to mounting concerns, Bokhari revealed that the government will not proceed with the legislation without addressing objections raised by journalist organizations. The government is open to dialogue and welcomes feedback on specific provisions of the law until the end of the week.

Amidst ongoing discussions, the Punjab government remains committed to ensuring that the defamation law strikes a balance between protecting individual rights and preserving freedom of speech.
