Understanding the Top City case that led to former DG ISI Faiz Hameed’s arrest, court martial proceedings

Former Inter-Services Intelligence (ISI) Chief Lieutenant General Faiz Hameed is reportedly facing a potential court-martial, stemming from allegations of misconduct related to the Top City housing scheme, according to a military announcement made on Friday.

In a statement issued by the Inter-Services Public Relations (ISPR), it was disclosed that the Pakistan Army conducted a comprehensive investigation, following directives from the Supreme Court. The inquiry revealed substantial breaches of the Army Act, leading to the initiation of disciplinary measures against Hameed, including the commencement of a Field General Court Martial (FGCM).

Top City Controversy

The Supreme Court of Pakistan had earlier mandated an investigation into the alleged misconduct of Lieutenant General (R) Faiz Hameed, which is tied to the controversial Top City housing scheme. The controversy revolves around accusations against the retired general and his associates, particularly related to a raid on the Top City Housing Scheme.

In 2023, Moeez Ahmed Khan, the owner of the housing scheme, filed a petition with the Supreme Court, specifically under the bench of Chief Justice Qazi Faez Isa. In his petition, Khan alleged severe legal violations during a raid conducted by Rangers personnel and ISI agents in May 2017 at the Top City office and the residence of Kunwar Khan, a prominent figure connected to the scheme.

Khan’s petition claims that during the unauthorized raid, the security forces confiscated valuable items including gold, diamonds, and cash, under the pretext of a terrorism investigation. The petition further asserts that following the raid, Sardar Najaf, who is reportedly Hameed’s brother, contacted Kunwar Khan along with a brigadier to set up a meeting. During this meeting, it is alleged that Hameed promised to return some of the confiscated valuables but retained 400 tolas of gold and a considerable amount of cash.

Moreover, Kunwar Khan has accused Hameed of malicious prosecution, claiming that retired ISI brigadiers Naeem Fakhar and Ghaffar applied undue pressure on him to pay 4 crores in cash and to provide support to a private television network. The petition also brings to light allegations that several former ISI officials were involved in an illegal takeover of the Top City Housing Society.

This investigation and the subsequent court-martial proceedings against Lieutenant General Faiz Hameed underscore the severity of the allegations and the broader implications for the reputation of the military and intelligence services in Pakistan.
