ECP has no other option but to implement apex court order: Kanwar Dilshad

ISLAMABAD: In a significant development, former Secretary of the Election Commission, Kanwar Dilshad, has emphasized that the Election Commission must adhere strictly to the Supreme Court’s recent decision concerning specific seats.

The Supreme Court’s explanatory ruling on September 12 clarifies its stance and demands immediate compliance. He stated this while addressing a private TV channel.

Dilshad asserted that the Election Commission’s prior request for clarification was an attempt to delay the implementation of the court’s ruling. According
to the Supreme Court, the Election Commission’s stance that PTI (Pakistan Tehreek-e-Insaf) is not a registered party was erroneous.

The court’s explanatory decision has underscored that PTI’s legal status as a registered party has already been established, and the Commission’s previous admission of Barrister
Gauhar as the party chairman reinforces this.

The Supreme Court’s ruling addresses the allocation of reserved seats, specifying that these seats should be distributed between PTI and the Sunni Etihad Council. The Commission, therefore, faces the imperative to execute this decision without further delay.

The court’s explanatory decision has criticized the Commission’s request for clarification as a deliberate attempt to obstruct the execution of the judicial ruling.

The media reports that the Supreme Court’s eight-judge bench emphasized that the Election Commission must not alter its position under the guise of seeking clarification. The court has warned of potential consequences if there is further delay in implementing its decision.

Amidst ongoing political tensions, the Chief Election Commissioner has been urged to resist any external pressures and ensure that the Supreme Court’s directives are enforced promptly. The development marks a crucial moment in the ongoing electoral process, with significant implications for PTI and other political entities involved.
